Trump Administration to Prosecute Kilmar Abrego Garcia After Unlawful Deportation

Jun 6, 2025 | Advocacy, Immigration, Press

Washington, DC – June 6, 2025 – Despite court orders and his unlawful rendition, the Trump administration plans to bring Kilmar Abrego Garcia back to the U.S. after they said they could not do it, not to correct their error, but to prosecute him on what advocates call baseless charges.

Kilmar, a Maryland resident and father of three, was deported to El Salvador in March 2025, violating a 2019 court order that protected him from gang threats. After weeks of stalling and disinformation—including the firing of a DOJ attorney who admitted the deportation was erroneous—the government now appears to be trying to justify its actions by criminalizing Mr. Garcia. CARECEN, joined Congressman Glenn Ivey’s visit to El Salvador to advocate for Kilmar’s release and safe return and t learn the current country conditions that led to an undisclosed agreement with the government of El Salvador, a country that has suspended civil liberties in exchange for security.

Background and Concerns
* Kilmar was unlawfully deported despite a court order, and both the district and Supreme Courts ordered his return. The government initially claimed it couldn’t bring him back but is now using its power to prosecute him, with trafficking allegations emerging only after court demands for his return.
* Due Process Violation: This case exemplifies a disturbing trend of government officials defying court orders and abusing power. His deportation was a direct violation of law, not a mistake, undermining the foundation of our justice system.
* Retaliation: The government cannot ignore court orders and then retroactively justify its illegal actions by criminalizing an individual. This sets a dangerous precedent, especially for Black and brown communities, and undermines judicial integrity.

Advocates and legal counsel demand the immediate cessation of these retaliatory charges and full compliance with court orders to ensure Kilmar Abrego Garcia’s safe and lawful return, free from unfounded prosecution.
